A Texas company operating an oil refinery and the managers thereof were recently indicted for allegedly infringing the law on migratory birds due to air pollution caused by benzene used at the plant’s site. The benzene was used to dilute liquid waste in tanks located at the routes of migratory birds. This practice generated benzene emissions which led to serious injury and death of birds. The importance of this case lies in the tendency of widening the scope of laws containing no specific environmental provisions so that they can be used in proceedings against corporate management for pollution caused by production facilities. The article reviews the case and its implications.
